I General provisions
Words capitalized and not defined below are given the meaning as in the Terms and Conditions of the Online Store available on the website: https://internetowa-hurtownia.en/Regulations-of-wholesalers-cterms-pol-18.html.
This document sets out the rules for the processing and protection of personal data of the Online Store available at https://internetowa-hurtownia.en/ (Privacy Policy).
The administrator of the personal data (Personal Data) of the Customers is Verk Group Sikorski Limited Partnership, based in Podolszyn Nowy, 16 Wygody Street, 05-090 Raszyn, e-mail: orders@internet-wholesale.en, phone: +48 888 055 550 ext. 2 or 22 670 90 10 ext. 2 , entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for m.st. Warsaw, XIV Economic Department of the National Court Register under KRS number 000531771, with NIP number 5342500808, with REGON number 360233917.
Personal Data, as referred to in the Privacy Policy, is information about an identified or identifiable natural person to whom the data relates, i.e. one who can be identified directly or indirectly, in particular on the basis of a characteristic such as name, identification number, location data, Internet identifier or one or more characteristics that define the physical, physiological, genetic, mental, economic, cultural or social identity of the natural person.
The Service Provider processes Personal Data of the subjects in accordance with the applicable regulations, in particular Polish law and the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, RODO).
Processing, as defined in the Privacy Policy, means an operation or set of operations performed on Personal Data or sets of Personal Data in an automated or non-automated manner, such as collecting, recording, organizing, structuring, storing, adapting or modifying, retrieving, viewing.
II Scope and purpose of the collected data
Personal Data is processed by the Administrator in the Online Store to enable the use of the functionality of the Online Store, including automatically during the use of the Online Store, i.e. for:
registration in the Online Store;
to conclude contracts through the Online Store, in particular to place and execute an Order, to conclude and execute a Sales Agreement;
the smooth running and operation of the Online Store and to ensure the security of its use, including for revealing abuse and making analysis;
fulfillment of the Seller's obligations, in particular complaints about contracts via the Online Store;
preparation and presentation of advertisements and offers tailored to the interests and needs of the persons to whom the Personal Data pertains, and receipt of commercial information, in particular, sending an ordered Newsletter by the Seller to the e-mail address indicated by the Customer;
for the publication of Content.
In order to:
Online Store registration - the following Personal Data are processed - name, e-mail address, Password, IP address, cookies;
concluding agreements through or available on the Online Store, in particular placing and executing an Order - the following Personal Data are processed: name and surname, address (street, house number, city with postal code), contact telephone number, order number, IP address, cookies or other data provided by the Seller on the Online Store or during contact with the Customer;
efficient conduct and operation of the Online Store and to ensure the safety of use, including for the disclosure of abuses, creation of reports and analyses, including statistics of viewing the subpages of the Online Store - the following Personal Data - mentioned above - are processed in point 8 b;
fulfillment of the Seller's obligations, in particular complaints regarding contracts concluded in the Online Store or through the Online Store and the operation of the Online Store - the following Personal Data are processed - name, surname, e-mail, telephone, address (street, house number, city with postal code), IP address, cookies, bank account number;
preparation and presentation of advertisements and offers tailored to the interests and needs of the persons to whom the Personal Data pertains, as well as receipt of commercial information, in particular sending an ordered Newsletter by the Seller to the e-mail address indicated by the Customer - the following Personal Data are processed: first name, last name, PESEL, gender, date of birth, marital status, e-mail, telephone, address (street, house number, city with postal code), IP address, cookies, Order number;
in order to publish Content - the following Personal Data are processed: name, surname, e-mail, nickname, IP address, cookies.
III Legal Basis for Processing Personal Data
The legal basis for processing Personal Data is:
consent of the person to whom the Personal Data relates to their processing;
necessity for the performance of contracts concluded in the Online Store or through the Online Store, or to take actions requested by the person to whom the Personal Data relates before concluding the contract;
necessity to fulfill the legal obligation of the Seller;
legitimate interests pursued by the Seller or by a third party, which are electronic payment operators or others carried out in connection with the functionality of the Online Store, while this basis for processing Personal Data does not apply to children.
In the case referred to in point. 9 a) Personal Data on children is processed only if the child is over 16 years of age.
IV Period of processing of Personal Data
Personal Data collected in the Online Store will be stored for billing purposes for a maximum period of 5 years, counting from the end of the calendar year in which the deadline for payment of tax related to the contract concluded through the Online Store has expired. To the other extent justified by the purposes of processing, Personal Data will be stored for as long as there is a legal basis for their processing, unless applicable law would require a longer storage period, e.g. for use in proceedings relating to the operation of the Online Store. At the end of the retention period, personal data will be deleted or anonymized.
V Voluntariness of providing Personal Data
Provision of Personal Data in the Online Store is voluntary, but necessary for the realization of one or more of the purposes of processing Personal Data defined in Section. 7 above, which the Seller will not be able to fulfill if Personal Data is not provided in the Online Store, respectively, for one or more of the purposes defined in Section. 7 above.
VI Profiling of Personal Data
Personal Data will be processed in an automated manner, including profiling for which information about purchases, activities in the Seller's sales channels (computer IP, cookies, preferred methods of purchase), socio-demographic data (e.g. gender, age, income, place of residence) ) are used, in order to tailor marketing information to individual preferences.
VII Cookies
The Service Provider informs that during the use of the Online Store, Personal Data is also collected automatically in the system logs of the Online Store, through Cookies files.
The Service Provider informs that from the moment the Client connects to the Online Store, information about the number (including IP) and type of the Client's final device from which the Client connects to the Online Store appears in the system logs of the Online Store. The Service Provider informs that, in accordance with the law, it also processes data concerning the number (including IP) and type of the Client's terminal equipment, as well as the time of the Client's connection with the Online Store and other exploitation data concerning the Client's activity in the Online Store. The described data is processed for technical purposes for the adaptation of the Internet Shop to the needs of the Customers and for the collection of general statistical information concerning the functioning of the Internet Shop.
The Service Provider uses cookies to collect information related to the use of the Online Store by the Customer. Cookies are computer data, in particular small text files, recorded and stored on the devices through which the Customer, uses the Online Store, which enable:
maintaining the Customer's session (after logging in), thanks to which the Customer does not have to re-enter the Login and Password on each sub-page of the Online Store,
adaptation and optimization of the Online Store to the needs of Customers,
personalization of marketing messages,
ensuring the security and reliability of the operation of the Online Store.
The Online Store uses session Cookies, which are deleted when the browser window is closed, as well as permanent Cookies, stored for a specified period of time in the devices through which the Customer uses the Online Store.
The Customer, may independently and at any time change the settings for Cookies, specifying the conditions for their storage and access by Cookies to the Customer's Device. Changes to the settings referred to in the preceding sentence may be made by the Customer through the settings of his/her Internet browser or through the configuration of the service. These settings can be changed, in particular, in such a way as to block the automatic handling of Cookies in the settings of the web browser or inform about each time Cookies are placed on the Client's Device. Detailed information about the possibility and methods of using cookies is available in the settings of the customer's software (web browser).
The customer can delete cookies at any time using the available functions in the web browser he uses.
Restricting the use of cookies may affect some of the functionality available on the Online Store.
VIII Rights and obligations of the service provider
The Seller reserves the right to disclose selected Personal Data to the competent authorities or third parties who make a request for such information, based on an appropriate legal basis, in accordance with the provisions of applicable law.
The Seller declares that it entrusts the processing of Personal Data, on the basis of a written agreement concluded in accordance with applicable regulations, to entities providing hosting, administration, maintenance and management of the Website to the Seller, as well as services in the field of message optimization and management of promotional campaigns.
The Seller declares that it entrusts the processing of the Customer's Personal Data to entities providing services to the Seller or directly to the Customer to the extent necessary for the use of the Online Store, including the implementation of agreements, in particular the Order, the processing of complaints, on the basis of a written agreement concluded in accordance with applicable regulations. Customers' Personal Data may be entrusted in particular to Product providers, Banks, Insurers, financial and insurance institutions.
IX Processing of Personal Data by Processors
Processors within the meaning of the Privacy Policy are the entities referred to in Section. 23 and pt. 24 that process Personal Data on behalf of the Seller.
The Processor is authorized and entitled to process Personal Data only for the purposes and to the extent specified in the Privacy Policy.
Personal Data may be processed only in Poland, a member state of the European Union (EU) or a signatory to the Agreement on the European Economic Area (EEA).
The Processor shall process the entrusted Personal Data in accordance with applicable laws and regulations, in particular the Processor:
applies the technical and organizational measures required by law, in particular with regard to the security of the processing of Personal Data.
applies measures to ensure: i) the ability to continuously ensure the confidentiality, integrity, availability and resilience of processing systems and services; ii) the ability to rapidly restore the availability of and access to personal data in the event of a physical or technical incident; iii) the regular testing, measurement and evaluation of the effectiveness of technical and organizational measures to ensure the security of processing.
applies security measures for Personal Data at a level not lower than that applied by the Seller.
The Processor may change, delete or block the processed Personal Data, only at the direction of the Data Controller. If the person to whom the Personal Data pertains requests directly to the Processor to change or delete his/her Personal Data, the Processor shall promptly, within no later than 5 business days, transmit such request to the Vendor.
The Processor should not process Personal Data for any purpose other than the performance of the obligations indicated in the Privacy Policy. Processor shall not disclose Personal Data to third parties.
The Processor shall be liable to the person to whom the Personal Data relates for damages that such person may suffer as a result of the Processor's acts and omissions.
X Rights and obligations of the Personal Data subject
Each customer has the right:
access to your Personal Data, the right to rectification, deletion and the right to request restriction of processing.
object to the processing of your Personal Data, withdraw your consent to the processing of your Personal Data for one or more of the purposes for which it was granted, at any time without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal, as well as the right to transfer your Personal Data.
In order to exercise the rights referred to in paragraph. 32 a) above should be sent by e-mail to: orders@internet-wholesale.en.
In order to exercise the rights referred to in paragraph. 32 b) above should be sent by e-mail to: orders@internet-wholesale.en by writing in the title the word "RODO objection" or "RODO withdrawal of consent" or send a written notice of withdrawal of consent to receive commercial information to the Seller's address: Verk Group Sikorski Spółka komandytowa Podolszyn Nowy ul. Wygody 16; 05-090 Raszyn, with the note PERSONAL DATA.
If the Customer places any personal data of other persons (including their name, address, telephone number or e-mail) on the Website, he/she may do so only under the condition of not violating the provisions of the applicable law and personal rights of such persons.
The Customer shall be entitled to use Personal Data and content provided by other persons in the Online Store only in connection with the use of the Online Store and with their consent in a manner consistent with the provisions of applicable law, unless he/she obtains permission from such other persons to process their Personal Data and content to the extent or for the purpose provided for in the Privacy Policy and beyond the use of the Online Store.
Each Customer has the right to file a complaint with the supervisory authority for the processing of Personal Data.
XI Security of Personal Data
The Service Provider declares that it endeavors to provide Clients with a high level of security in the use of the Online Store and to this end:
applies the technical and organizational measures required by law, in particular with regard to the security of the processing of Personal Data;
applies measures to ensure: i) the ability to continuously ensure the confidentiality, integrity, availability and resilience of processing systems and services; ii) the ability to quickly restore availability of and access to Personal Data in the event of a physical or technical incident; iii) the regular testing, measurement and evaluation of the effectiveness of technical and organizational measures to ensure the security of processing.
Any events affecting the security of transmission of information, data, including the suspicion of sharing files containing viruses and other files of a similar nature or other than files of destructive mechanisms should be reported to the Vendor at e mail address: zamowienia@internetowa-hurtownia.pl with the title: NOTIFICATION OF ERROR.
XII Final Provisions
In matters not regulated in the Privacy Policy, the provisions of the law on the processing of Personal Data, including the RODO, shall apply.
